Environmental or "Green" Claims


More consumers than ever are interested in the operating costs of a product will be, both in terms of their pocketbook and the toll on the planet.  In recent years, folks have started to talk about the "carbon footprint" of products.  Companies have heard this refrain loud and clear and have labeled more products than ever with claims that they are “environmentally friendly” or “energy efficient.” What these claims actually mean, however, is sometimes uncertain.

Each of the states as well as the federal government have the authority to prevent “deception” and “unfairness” in the marketplace. That authority extends to scrutiny of advertising associated with a given product and includes claims made on the product (by way of a label), in accompanying literature, or even in the corporate logos or symbols used.  Monetary penalties, consent decrees, and even removal of a product from sale are all very real possibilities if the government agency involved believes that the environmental or “green” claim can not be substantiated.

What does it mean to “substantiate” a claim? Simply put, a company needs to have a reasonable basis for the claims made. One of the ways that such claims can be documented or substantiated is with the use of technically sound test procedures. Because we have extensive product experience, we have a bevy of scientific and technical resources available.

We fully expect that there will be far more activity and enforcement of environmental or “green” claims in the near future. Notably, the US Federal Trade Commission is now reviewing and revising its “Green Guide.” Various state agencies are choosing to spend far more of its enforcement budget on checking the accuracy of these types of claims.

In short, every company involved in the manufacturing or offering of a consumer product needs to be aware of all new developments in this area.
